strategist gary nordlinger from george washington school join us. thank you for being here. >> good afternoon. >> the fact that the unemployment rate fell below 8% the first time since the president took office should give them a boost. is it enough to help erase the lackluster performance in the debate? >> i don't know if it's enough to equal out the debate. the point is that it's good news for them and for the first time since january of 2009, unemployment dropped below 8% and that is great and upexpected news for the president. >> mitt romney called this insignificant. do you think that is a fair assessment of this or is this politics? >> reporter: the president's not responsible for the unemployment rate. what he's responsible for, i think s wasting three or $4 trillion, $3.5 trillion getting nothing for it. i think romney's point, you know, the stimulus spent a trillion, 80% of it wasted in paying down state debt.

with safans. the american freedom defense initiative sued last month for the right to display the ads metro stations. they up in subway stations in new york city and the judge said they must be displayed in the d.c. area no later than 5:00 on monday. the metro sportsperson said that metro will comply with the order and the ads will go up this weekend. robert muse of the american freedom law center joins us live by phone. the attorney for a blogger who sued the right to put up the ads and good to have you with us, sir. >> it's great to be with you, sir. jot real fear here from metro, and i think, new york subways as well was the potential violence in the middle east, after the movie depicted someone who was bad or equated as a fraud. you didn't see it this way? no, in fact to equate that violence to anything that -- is pure speculation.

one of the things can you see, and i am sure one of the viewers will see, all of the activity and violence going in the middle east. in a civil society, if you object to speech, the response to that is not to engage in violence but more speech and we held the protection of the first amendment here in the united states and the judge upheld that and in her ruling today. that is the correct way to go. >> robert, some people would say these are fighting words. yes, protect the speech indeed, but fighting words like going into a movie hevi olence. the reality, we have broad protection under the first amendment for good reason. i would think a news reporter like yourself would understand that and want that and someone who opposes the message being conveyed and if you upheld the

obviously. they're protecting the rights of freedom of speech. >> okay. >> the city is going to prohibit as in washington, d.c., they will likely be sued again and i suspect we'll win again. >> robert muse on the phone with us. good to you have here, sir. >> and thank you for having me. another big story at 5, new information in the july altercation outside of a capitol hill 7-eleven that left political analyst david mercer with a serious head injury. no criminal charges will be filed in the case and the case is now closed. >> reporter: what happened to david mercer outside of the maryland avenue 7-eleven, police and prosecutors are satisfied it was not a crime. the man who hit him claims to have done it in self-defense. last july 12th around 10:00 p.m., the political consultant david mercer walked into this 7- eleven where he got into a dispute with one of those men. law enforcement sources say

mercer may have thought one of the men stole something from him. and he reached in to the man's pocket tote retrieve it. as -- pocket to retrieve it. the dispute got heated as the men left the store. this is what police had to say in the days after the incident. >> at this point in time, this is not a random assault. we don't believe that this involved a robbery, but there was a dispute betwe the complainant and another individual. >> reporter: he was hit once once in the face and fell backward hitting his head. the man who threw the punch claims to have been defending himself. at mercer's capitol hill home, there was no answer. the next door neighbor said he has not seen the consultant since the attack. here's his health and it's improving. he was not happy to hear the case is closed. >> i am disappointed and have known david for over a decade. he's a brilliant guy and to

think he's permanently impaired because of this incident really -- breaks my heart that that their can't be anymore action for justice to take place. >> reporter: the exact condition couldn't be learned until he was injured in july. he was a frequent guest on the cable networks, sharing his expertise on the political area. we were unable to reach mercer or his family. one of the note, some media outlets reported in the days after the incident that mercer's phone was stolen and showed video that bolstered the story. >> paul wagner, thank you. developing in virginia. the number of suspected cases linked to a deadly meningitis outbreak is up to five. the patients who received steroids shots for back 59 contaminated with the fungus rose to at least 630.

drinking establishments, bars and restaurants that will be allowed to stay open throughout the district. it's a sunday to monday and you remember there was a controversy here and they allowed bars to stay open an hour later every weekend but others didn't like that at all and came up with a compromise to allow the bars to stay open. this is the first time it will happen on sunday night. the longer hours will take place sunday night into monday morning. the bars a proved on this list will be authorized to stay open until 4:00 a.m. this is something the council member worries about. >> the key problem is there is no public transporting a. people who want to go drinking until the later hour will driver and they will have to take a taxi.

and so i think the congestion, the noise is likely to increase. maybe not this weekend but as the program expands. >> reporter: he tried to kill the legislation to keep the bars open later. he didn't win that fight but scored a victory by trimming the late hours to holiday weekend instead of all weekend. >> and this first weekend, only 42 got permission. >> there was a concern about safety. early yet morning when the bars let out, an hour later. we talked to chief lanier several times about this and she didn't see any problems at all and that there are officers on the street at 3:00 and 4:00 and did not see a problem with that and man residents who live

like this are concerned because it causes a lot of noise, they say, and the people coming out of the bars are typically loud and keep them up late at night. back to you. >> all right, matt ackland, thank you. four d.c. police officers indicted in a vicious beating were offered plea deals. the announcement made during a status hearing in the case. yolanda lampkin is accused of obstruction of justice and perjury while the other three officers are accused of taking part in the beating or making an arrest after the assault. walter blair and another man were brutally assaulted outside of the lotus night club on k street. a total of nine people were indicted and the trial was scheduled for may. and to prince georges county. sky fox over the scene about 9:00 this morning over 85th avenue and in new carrollton. look at the photo of one of the rescues. crews were able to remove a

woman and a four--month-old child from a third story apartment and they rescued another from the second floor. as bad as it looked here this morning, no one was hurt. it's still fall, but folks in denver, colorado, woke up to snow on the ground. the area doesn't so any flakes until mid-october. and temps dropped below freezing and should start feeling like fall again this weekend. >> i was going say. we better not find a dusting on the was going re for a big c pretty ground. >> and can you imagine? >> i guess we should prepare for a big chill, huh? >> definitely. sunday is not going to be pretty around here.

we -- well, we tweaked the forecast a bit and you have to know that on sunday, you're talking about the cold rain and it neigh start -- it may start off in the mid-50s on sunday and as we progress through the day, it might be cooling into the lower 50s and in some cases, the upper 40s out there and that is going to be one of the yucky days. as we're past that into next week, it looks like things are going to be okay. we have the no -- had no worries today. the temperatures in the lower 80s for everybody and that looked like we maxed out at 82 degrees and a few clouds in some cases, the fair weather clouds, no big deal and it looks like this is going to translate into most of tomorrow and crow will have a chance of rain tomorrow and fair skies the rest of the evening and dropped into the upper 60s by 11:00 and chilly this morning in the suburbs and that is chilly again early tomorrow morning out on the suburbs and

sunday and that is not looking like heavy rain and the temperatures will be dropping through the day andfo 4, 5:00 on sunday afternoon, they may end up having temperatures in the upper 40s in some places. sunday is looking rainy and raw, pretty good tomorrow for most of the day and more in the waif clouds and sun. here we are now, kind of stuck in the middle, a few clouds to the south-southeast. off to the shore here and then back to the north-northwest. more clouds. tomorrow is not going to be as much or sunny as where we have been today. but it still looks like it's going to be nice. overnight tonight, a few clouds. the suburbs are dropping again down into the mid- to upper 50s in town. just lower 60s should do it. the winds out of the southwest at 5 to seven miles an hour. and as we take you through the day tomorrow, i think it's going to be a cool start.
